Terms and Conditions

Bookings from all clients shall be bound by the following terms and conditions. They shall include all bookings made from any medium and shall form a binding contract between the two parties.

The right to cancel a booking, at any time, shall be retained by PROSOUNDS, should they consider any venue to be unsuitable, dangerous or unsafe to the performers or other persons.

An immediate termination of services shall apply if any performer, or persons assisting the performer, are subjected to any form of abuse, threat, mistreatment, insult or any other form of unreasonable behaviour, or the performance is unable to take place in a safe, non abusive environment. Should the services be terminated in these circumstances then no refund, or part refund, shall apply.

Access to the relevant venue/location shall be granted at least 2 hours prior to the commencement of the performance, and 1 hour after completion, for the purposes of installation, dismantling, removal and vacating, and testing of relevant sound and lighting equipment.

Should access to the venue/location or performance area not be available, due to circumstances out of the performers control, then no refund, or part refund shall apply.

The client shall assume responsibility to provide safe and adequate power supplies, and relevant services, at the venue. That shall include at least 2 (two) independent standard working sockets. The client shall also ensure the venue has the relevant fire precautions and equipment required.

The client shall, at all times, ensure that adequate provision is made for the supervision of all guests, including children. The client shall be liable for any loss or damage caused to the equipment, personal belongings or reputation of PROSOUNDS, by themselves or guests, through unreasonable behaviour. Under these circumstances PROSOUNDS reserve the right to terminate all services without refund.

The client shall ensure that no person, or persons, shall interfere with any form of power supply or equipment related to the performance. Should this not be the case, then the performance shall be terminated immediately, for safety reasons, without refund.

Delays in the start of the performance, and not under the control of the performer, shall not incurr penalties or a reduced fee. However, in the unlikely event of total equipment failure, excluding circumstances beyond the control of the performer. ie.....power failure or similar....then a pro rata refund shall be made.

The performer shall not be liable for any injuries sustained or caused by the actions of the client or any of the clients guests. This shall include actions through intoxification by alcohol or other substances, but shall not be restricted to these.

The performer, or persons assisting, shall conduct themselves in a proper and polite manner at all times. They shall agree to react to specific requests regarding the location of equipment, volume controls and lighting displays, when possible.

Upon agreement of terms and conditions, a booking shall be deemed made, upon receipt of a deposit from the client to PROSOUNDS or their representative. The deposit shall be a sum of 100 euros, unless otherwise stated, and shall be non refundable, with exceptions. See below.

Any outstanding balance or fee shall be paid in cash, prior to the start of any performance, unless paid prior or otherwise agreed. Failure or payment shall result in the non provision of services.

Any cancellation advised more than 28 days prior to the agreed performance shall incur no fee and a refund of deposit shall be made.

Any cancellation made between 28 and 0 days days prior shall incur the loss of deposit only.

Notice of cancellation shall be deemed to have been made when the client receives CONFIRMATION from PROSOUNDS, and shall not be made final until that time. The client shall retain proof of cancellation at all times.

In the unlikely event that PROSOUNDS should cancel due to sickness, or other unforeseen circumstances, then a full refund of monies paid shall be made to the client. This shall be the full and final extent of liability on behalf of PROSOUNDS:
